Welcome to Munka Technologies Incorporated ("Munka", "we", "our", or "us"). These Terms & Conditions ("Terms") govern your access to and use of the Munka website, mobile applications, and related services (collectively, the "Platform").
By creating an account, accessing, or using the Platform, you agree to comply with these Terms. If you do not agree, you must discontinue use of the Platform immediately.
ABOUT MUNKA
Munka provides a digital marketplace that connects businesses, individuals, staffing agencies, and independent contractors for temporary, part-time, and task-based work opportunities.
Munka is solely a technology platform that facilitates these connections and does not employ workers or provide staffing services.
ELIGIBILITY
To use the Platform, you must:
• Be at least 18 years of age (or the age of majority in your jurisdiction).
• Have legal capacity to enter into binding agreements.
• Comply with all applicable local, state, federal, and international laws.
• Provide accurate registration information.
USER ACCOUNTS
You agree to:
• Provide accurate and current information.
• Keep your login credentials secure.
• Notify us immediately of any unauthorized account activity.
• Maintain only one personal account unless otherwise approved by Munka.
You are responsible for all activity occurring under your account.
PLATFORM SERVICES
Munka provides technology that allows Users to:
• Post jobs
• Search available jobs
• Accept work opportunities
• Process payments
• Communicate through the Platform
Munka does not supervise, direct, or control how services are performed between users.
USER ROLES
Users may act as:
• Hirers
• Contractors
• Agency Users
• Multiple roles simultaneously
Each role carries its own responsibilities under these Terms.
INDEPENDENT CONTRACTOR RELATIONSHIP
Contractors acknowledge that they are independent contractors and not employees of Munka.
Contractors are solely responsible for:
• Taxes
• Insurance
• Licenses
• Equipment
• Transportation
• Benefits
Nothing in these Terms creates an employment relationship between Munka and Contractors.
PAYMENTS
Payments are processed through trusted third-party payment providers such as Stripe.
By using the Platform, you authorize Munka to:
• Process payments
• Collect platform fees
• Issue refunds where applicable
• Process contractor payouts
Platform fees may change at any time.
FEES
Munka may charge:
• Transaction fees
• Service fees
• Subscription fees
• Administrative fees
Applicable fees will be displayed before completing transactions.
CANCELLATIONS & NO-SHOWS
Users agree to comply with Munka's cancellation policies.
Repeated cancellations, late cancellations, or failure to appear for scheduled work may result in:
• Account restrictions
• Suspension
• Reduced visibility
• Permanent termination
BACKGROUND CHECKS
Munka may require or provide optional background checks through third-party providers.
Background checks:
• Are not guarantees of safety.
• May not be fully accurate.
• Should not replace personal judgment.
SAFETY
Users are responsible for their own safety.
Hirers agree to:
• Provide safe work environments.
• Follow workplace safety laws.
Contractors agree to:
• Follow safety procedures.
• Decline unsafe work.
Munka cannot guarantee the safety of any job or user.
PROHIBITED ACTIVITIES
Users may not:
• Break any laws.
• Post false information.
• Impersonate others.
• Harass or discriminate against users.
• Use bots or automated systems without permission.
• Interfere with Platform operations.
• Commit fraud.
• Abuse payment systems.
• Upload malicious software.
Violation of these Terms may result in immediate account termination.
RATINGS & REVIEWS
Users may leave ratings and reviews.
Munka reserves the right to:
• Moderate reviews.
• Remove inappropriate content.
• Suspend accounts based on abusive conduct.
AGENCY ACCOUNTS
Staffing agencies are solely responsible for:
• Their workers.
• Payroll.
• Taxes.
• Employment compliance.
• Legal obligations.
Munka assumes no responsibility for agency workers.
INTELLECTUAL PROPERTY
All Platform content including logos, branding, software, graphics, text, source code, and designs are owned by Munka or its licensors.
No content may be copied, reproduced, or distributed without prior written permission.
USER CONTENT
Users retain ownership of the content they submit but grant Munka a worldwide, royalty-free license to use, reproduce, display, modify, and distribute such content solely for operating and improving the Platform.
THIRD-PARTY SERVICES
Munka may integrate third-party services including payment processors, analytics providers, messaging platforms, identity verification providers, and background screening services.
Use of those services is subject to their respective terms and privacy policies.
DISCLAIMER
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE."
Munka makes no warranties regarding:
• Platform availability
• Job availability
• User conduct
• Earnings
• Reliability
• Platform accuracy
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Munka shall not be liable for:
• Lost profits
• Lost data
• Business interruption
• Indirect damages
• Consequential damages
• Punitive damages
Munka's maximum liability shall not exceed the greater of:
• USD $100; or
• The fees paid by you to Munka during the previous twelve (12) months.
INDEMNIFICATION
You agree to indemnify and hold harmless Munka, its affiliates, directors, officers, employees, and agents from any claims, liabilities, damages, or expenses arising from:
• Your use of the Platform.
• Violation of these Terms.
• Violation of applicable law.
• Disputes with other users.
PRIVACY
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal information.
ARBITRATION & CLASS ACTION WAIVER
Any dispute arising from these Terms shall be resolved through binding arbitration under the laws of the State of Delaware, United States.
You waive the right to participate in class action lawsuits or jury trials where permitted by law.
TERMINATION
Munka may suspend or terminate any account at its sole discretion for violations of these Terms or for any lawful reason.
Users may close their accounts at any time.
CHANGES TO THESE TERMS
Munka reserves the right to modify these Terms at any time.
Updated Terms become effective immediately upon publication on the Platform.
GOVERNING LAW
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
